Owners Consent Authorisation

This authorisation will be accepted as owners consent in relation to any application for proposed development, under the Environmental Planning and Assessment Act 1979Local Government Act 1993 and Roads Act 1995. 

Please include this in your attachments on the NSW Planning Portal when submitting your application.  

Before completing the Owner's Consent form please note:

All owners of this land must sign this form. If there is more than one owner of the land, every owner must sign.

Please review the below land/property ownership types to check what additional MANDATORY documentation will be required in addition to the owner's consent when submitting an application to the NSW Planning Portal or a Council Application for that application to be accepted and processed.

Owner is a Company/Organisation

Company/Organisation: - If the owner is a company, the owner’s consent must be signed by one company director and one company secretary, or two (2) company directors. Where the company has one director or secretary, only one signature is required. 

The applicant must provide the names and positions of those signing the consent and a current company extract from the Australian Securities and Investment Commission (ASIC) dated within 6 months of the date of submission. 

 

 

Corporate Body

Corporate Body: - If signing on behalf of a Corporate Body, the application should be signed by an authorised person and the position of that person in the corporate body must be stated on the form. A current company extract from the Australian Securities and Investment Commission (ASIC) dated within 6 months of the date must be submitted.

 

Not for Profit Organisation

Not For Profit Organisation: - Not For Profit bodies are required to provide the names and positions of those signing the consent and a current extract from The Australian Charities and Not for Profits Commission (ACNC) dated within 6 months of the date of submission.

To apply for a waiver of the Council fees, the request must be made in cover-letter and the following criteria must be met:

a. The approved project is on Council owned or controlled land.

b. The applicant is a not-for-profit club, organisation, community group or charitable organisation and is in effective control of the subject land.

c. A request to waive development application fee is made in writing to Council and sets out the community benefit that will be achieved from the development.

d. This request must be uploaded to NSW Planning Portal along with the other documents submitted with the application.

Not for Profit Club, Community Group or Charitable Organisations Application Fee Waivers - Not on Council Owned Land

In the case of a registered Not for Profit Club, Community Group or Charitable Organisation seeking a Fee Waiver for the Council Development Applications fees if the Development Application that is NOT on Council owned land. A Fee Waiver is NOT applicable.

 

 

 

Owner is Strata Title/Owner's Corporation

Strata Title: - If the property is a unit under strata title, then in addition to the consent of the owner(s) of the unit, owner’s consent from the owner’s corporation must be provided if any works or proposed use will affect common property. 

The owner’s consent from the owner’s corporation must be signed in line with section 273 of the Strata Schemes Management Act 2015 (NSW) by way of the seal of the owner’s corporation being affixed in the presence of: 

  • Where the owner’s corporation has only one owner, that owner or the strata managing agent 

  • Where the owner’s corporation has only two owners, both those owners or the strata managing agent 

  • Where the owner’s corporation has more than two owners, either of the following; 

  • Two owners as determined by the owner’s corporation 

  • The secretary of the owner’s corporation and any other member of the strata committee 

  • The strata Managing Agent. 

 

 

Signing on Owner's Behalf

Signing on owner’s behalf: - If you are signing on the owner’s behalf as the owner’s representative, you must state the nature of your legal authority and attach documentary evidence of your authority – a full copy is required.  Depending on the nature of your authority, the following evidence may be accepted; 

  • Power of attorney 

  • Trust deed 

  • Probate 

  • Letters of administration 

  • Delegation schedule 

 

Owner of the land is Council

Council-owned land If the property is Council-owned, this form must be issued to Council for authorisation.

Owner are new owner/s of the land/property

New Owners: - If the property has recently been sold, evidence of the new owners being the registered owner must be provided with a copy of the certificate of title.
