Update Following Repoly Appeal Conciliation Conference

Wingecarribee Shire Council is providing this update following today’s Land and Environment Court conciliation conference regarding Repoly Pty Ltd’s Appeal against the Independent Planning Commission’s (IPC) refusal of the proposed Moss Vale Plastics Recycling Facility. 

Council was nominated as one of only six speakers, invited by the Crown Solicitor on behalf of the IPC to address the Commission as part of the formal conciliation process. Participation in the conciliation conference is by invitation only. 

Council took this opportunity to clearly restate its objection to the proposal and to reaffirm its support for the IPC’s determination of refusal. Council’s full Statement of Objection has been uploaded to the website

Council’s Position 

  • The site is in the SHIP Master Plan’s Research, Training and Advanced Manufacturing precinct, designed to protect nearby residences and research facilities. 
  • The proposal would cause unacceptable noise, traffic, visual impacts, and raises unresolved concerns about microplastics. 

  • The development conflicts with local and State planning objectives and more suitable locations exist. 

  • Council maintains its formal objection and supports the IPC as the determining authority. 

The matter remains before the NSW Land and Environment Court, and no determination on the appeal has been made. The next step in the process is a Directions Hearing, which is scheduled for 24 November 2025 by the Court following the conciliation conference.
