Development Applications

Overview

Development Applications (commonly called DA’s) are a formal request for permission to carry out a proposed development including building, subdividing, change of land use, landscaping or other works.

It is important to know how to submit a DA properly so you can get Council approval. Poorly prepared applications may be rejected.

Should I have a Prelodgement Meeting

Council Planners do not offer a design consultancy service or undertake research to identify planning controls, however, for larger proposals, it would be useful to have a prior discussion with Council's assessment staff.

All Development Applications and Complying Development Certificates must be lodged to Council through the NSW Planning Portal

Submitted DAs

Once you have submitted your application via the Planning Portal, Council will be notified of your new application. Council staff will then review your application to determine if any additional information is required. Should any additional information be required, you will receive an email notification generated from the Portal requesting the relevant information to be submitted (via the Portal).

When Council is satisfied with the documentation submitted with your application, you will receive an email notification generated from the Portal requesting fees to be paid for your application. Once fees are paid, your application will be formally lodged with Council and progressed through for assessment. 

Approved Development Applications

In accordance with Section 4.59 of the Environmental Planning and Assessment Act 1979, Wingecarribee Shire Council is required to give notice of development consents, including modifications and review of determinations and complying development certificates within a certain period. 

If public notice of the granting of a consent or a complying development certificate is given in accordance with the regulations by a consent authority or an accredited certifier, the validity of the consent or certificate cannot be questioned in any legal proceedings except those commenced in the Court by any person at any time before the expiration of 3 months from the date on which public notice was so given. 

 

 

Clause 4.6 Variations Register

Under the Wingecarribee Local Environmental Plan, 2010, Council is allowed some flexibility when applying planning controls to certain developments, and maintains a register of these variations to then be submitted quarterly to the Department of Planning, Industry and Environment.

It is important to note that these developments, whilst they may not meet certain development standards, are achieving planning objectives set by Council.

All written submissions in respect of the proposed development which are received during the above period of public exhibition will be taken into consideration by the consent authority prior to any determination of the Development Application.

If you make a submission on this proposal you must complete the Disclosure Statement of Political Donations and Gifts:

  • Political donations of $1,000 or more (or smaller donations totalling $1,000 or more); or
  • Gifts as defined by the Election Funding and Disclosures Act 1981

made in the two years prior to the application date by you or any person who has a financial interest in the application (this is available from the Council or website www.wsc.nsw.gov.au).
