An interim heritage order (IHO) is a mechanism under the NSW Heritage Act 1977 which provides immediate protection over “a place, building, work, relic, moveable object or precinct in the council’s area that the council considers may, on further inquiry or investigation, be found to be of local heritage significance, and that the council considers is being or is likely to be harmed” (section 25 of the Heritage Act). Council has been given delegation from the Minister to issue its own Interim Heritage Orders and IHOs are valid for six (6) months while Council undertakes an assessment of the heritage significance of the place. If Council should decide to proceed to listing the place as a heritage item, the protection under an IHO will be extended for a further six (6) months.
The following Interim Heritage Orders have been recently issued by delegation by Council and are currently valid.
Council placed an Interim Heritage Order (IHO No. 8) over Welby Park Manor, 28 Old Hume Highway, Welby, which was published in the NSW Government Gazette on Friday 21 December 2018. The decision to issue the IHO was in response to a development application (DA 19/0765) for a six lot subdivision over the site. A copy of the Gazette Notice can be downloaded below. A heritage assessment of the site has been undertaken and heritage listing was recommended by staff in its report to Council on 12 June 2019 (item 13.6, from page 259) but Council resolved to defer a decision on listing for six (6) months. Consequently, Interim Heritage Order No. 8 has now lapsed.
Aitken Road Bowral Group - IHO No. 9 (extended to 18 January 2020)
Council placed an Interim Heritage Order (IHO No. 9) over five properties in Aitken Road, namely nos. 25-27, 29, 31, 33-37 and 39-41. The IHO was published in the NSW Government Gazette on Friday 18 January 2019. The decision to issue the IHO was in response to a development application on one of the lots (DA 19/0574 on 39-41 Aitken Road) for a 108 room residential care facility. The subject properties include three substantial dwellings building in the early 20th century with substantial mature gardens. A copy of the Gazette Notice can be downloaded below. A heritage assessment has been undertaken which was reported to Council on 10 July 2019 (item 11.4, from page 270) and Council adopted the officer's recommendation to support heritage listing of 25-27, 33-37 and 39-41 Aitken Road, Bowral as the 'Aitken Road Interwar Housing Group' and create a new heritage conservation area to protect the Aitken Road area. Council staff will now prepare a Planning Proposal for submission to the Department of Planning, Industry and Environment to commence the heritage listing process.
Rochester Park, Bundanoon - IHO No. 10
Council placed an Interim Heritage Order (IHO No. 10) over 'Rochester Park' at 102-104 Old Wingello Road, Bundanoon, which was published in the NSW Government Gazette on Friday 22 February 2019. The decision to issue an IHO was in response to a development application (DA 19/1088) for a 12 lot subdivision over the site. A copy of the Gazette Notice can be downloaded below. Council will now undertake a heritage assessment of the site to determine its heritage significance and to help make a decision about whether to proceed with heritage listing.
