The process of investigation and determination can take up to 8 weeks. While we endeavour to respond to claims as quickly as possible, such claims can be complicated. We ask for your patience and co-operation while your claim is investigated and assessed.
All claims will be assessed in accordance with the NSW Civil Liability Act 2002. Accordingly, Council may not be liable for damages arising from potholes or other hazards unless Council was aware of that particular risk and failed to address the issue.
For a claim to be considered, evidence must be provided to us for consideration. The onus lies on the claimant to provide sufficient evidence or proof to substantiate the claim. The lodgement of this claim form does not mean Council automatically accepts liability.
