Planning Proposal - To Reclassify Four (4) Properties

NOTICE OF PUBLIC EXHIBITION OF PLANNING PROPOSAL TO AMEND THE WINGECARRIBEE LOCAL ENVIRONMENTAL PLAN 2010 FOR FOUR (4) PROPERTIES


The subject Planning Proposal includes the reclassification of land for two reasons: Site 1 and Site 2 are being reclassified in order to register easements across Council land so as to gain access to two (2) separate existing approved developments. Sites 3 & 4 are being reclassified from ‘Community’ to ‘Operational’ in accordance with Council’s resolution on 24 April 2013.


The Planning Proposal will amend the Wingecarribee Local Environmental Plan 2010 (LEP 2010) by making the following changes:


• To reclassify four (4) properties from ‘Community’ land to ‘Operational’ under Schedule 4 Classification and reclassification of public land of the Wingecarribee Local Environmental Plan 2010.
• To rezone one (1) property in Beavan Place and one (1) in Una Street from RE1 Public Recreation to R2 Low Density Residential under Wingecarribee LEP 2010
• To provide a Minimum Lot Size for the Beavan Place and Una Street properties of 700 Square metres (sqm) to be consistent with adjoining properties (with the same minimum lot size) under Wingecarribee LEP 2010.


Please note that as required by Section 29 of the Local Government Act, 1993 a public hearing was held 21 days after the exhibition period has closed. A further Notice will be placed in the Southern Highlands News advising the date of the public hearing.


On the 29 November 2013 the Department of Planning & Infrastructure issued a Gateway Determination for Council to proceed with the exhibition of the Planning Proposal.

STATUS: At its meeting of 14 May 2014 the Planning and Strategic Peak Committee of the Whole resolved each property ad seriatim as follows:



1. THAT in accordance with Section 59 of the Environmental Planning and Assessment Act 1979 and the Guide to Preparing Local Environmental Plans, Council proceed with the Planning Proposal to amend Schedule 4 Reclassification and classification of public land of Wingecarribee Local Environmental Plan 2010 (WLEP 2010) by reclassifying the following property from ‘Community’ to ‘Operational’:


Site 1: Lot 1 DP 1128360, Hume Highway, Paddy’s River (PN 657900) be approved


2. THAT persons who made written submissions and attended the public hearing be advised of Council’s decision.

THAT in accordance with Section 59 of the Environmental Planning and Assessment Act 1979 and the Guide to Preparing Local Environmental Plans, Council proceed with the Planning Proposal to amend Schedule 4 Reclassification and classification of public land of Wingecarribee Local Environmental Plan 2010 (WLEP 2010) by reclassifying the following property from ‘Community’ to ‘Operational’:


Site 2: Lot 6 DP 249793, Old Hume Highway, Berrima (PN 665400) be approved


2. THAT persons who made written submissions and attended the public hearing be advised of Council’s decision.



1. THAT in accordance with Section 59 of the Environmental Planning and Assessment Act 1979 and the Guide to Preparing Local Environmental Plans, Council proceed with the Planning Proposal to amend:


A. Schedule 4 Reclassification and classification of public land of Wingecarribee Local Environmental Plan 2010 (WLEP 2010) by reclassifying the following property from ‘Community’ to ‘Operational’:


Site 3: Part Lot 8 DP 241836, Beavan Place, Bowral (PN 128600) be approved


B. The zoning map applicable to Site 3 (Lot 8 DP 241836) from RE1 Public Recreation to R2 Low Density Residential under WLEP 2010.


C. The minimum lot size map applicable to Site 3 from ‘no minimum lot size’ to ‘Q’ (700 sqm) under WLEP 2010.


2. THAT persons who made written submissions and attended the public hearing be advised of Council’s decision.



1. THAT in accordance with Section 59 of the Environmental Planning and Assessment Act 1979 and the Guide to Preparing Local Environmental Plans, Council proceed with the Planning Proposal to amend:


A. Schedule 4 Reclassification and classification of public land of Wingecarribee Local Environmental Plan 2010 (WLEP 2010) by reclassifying the following property from ‘Community’ to ‘Operational’:


Site 4: Lot 42 DP 911852, Una Street, Bowral (PN 1779770)


B. The zoning map applicable to Site 4 (Lot 42 DP 911852) from RE1 Public Recreation to R2 Low Density Residential under WLEP 2010.


C. The minimum lot size map applicable to Site 4 from ‘no minimum lot size’ to ‘Q’ (700 sqm) under WLEP 2010.


2. THAT persons who made written submissions and attended the public hearing be advised of Council’s decision.



The Minister for Planning & Infrastructure has determined that Wingecarribee Shire Council, as the Relevant Planning Authority will determine this Planning Proposal under delegated authority.
