At its Ordinary Meeting of 14 December 2016 Council resolved to publicly exhibit Draft Garden World Voluntary Planning Agreement, proposed to be entered into by Development Implementation Pty Ltd and Wingecarribee Shire Council.
The Voluntary Planning Agreement (VPA) applies to the ‘Garden World’ site located at 520 Old South Road Mittagong.
Following feedback from the February 2017 exhibition of the Draft Garden World Planning Agreement, proposed to be entered into between Development Implementation Pty Ltd and Wingecarribee Shire Council,
a revised Draft is being re-exhibited from Wednesday 26 April.
Due to problems with Council’s website and the display of all relevant documentation, the re-exhibition period has been extended a further two (2) weeks to Friday 9 June 2017.
The objective of the Draft Planning Agreement is to secure funding, land and the carrying out of work, including the establishment, dedication and management of drainage management land in conjunction with the development, in accordance with approvals under DA11/0767.
DA11/0767 is to be re-notified soon in accordance with Council's adopted Notification Policy.
The Draft Planning Agreement is a planning agreement under s93F of the Environmental Planning and Assessment Act 1979) (the Act). The Draft Planning Agreement is a voluntary agreement under which Development Contributions (as defined in clause 1.1 of the Draft Planning Agreement) are made by the Developer for various public purposes (as defined in s93F(3) of the Act).
The effect of the Draft Planning Agreement is summarised in the Appendix starting on page 48 of the draft Agreement. Two (2) references to Lomandra Lane have been included to provide clarification.
It should be noted with regard to Lomandra Lane that is intended it remain a ‘one way street’, consistent with the road design. However, during the initial stages of the Garden World development, to the creation of a maximum of 70 lots as provided in DA11/0767, traffic on Lomandra Lane will flow in a southerly direction (that is, from north to south). No further lot creation beyond 70 lots can occur on the Garden World site until the Eastern Portion of Isedale Road is completed, at which time the traffic flow on Lomandra Lane will most likely be in a northerly direction (that is, from south to north).
